Oxxy Terms of Use

1. Who provides the service and acceptance

Oxxy, at oxxy.ai, is provided by OXXYGENIUM DIGITAL TECHNOLOGIES SERVICOS E COMERCIO LTDA, CNPJ 04.104.812/0001-38. By using Oxxy, you agree to these terms and to the Privacy Policy. If you do not agree, do not use the service.

Anyone who signs up on behalf of a company represents that they have the authority to do so.

2. What Oxxy is

Oxxy is a business management system, with modules and an AI assistant called Orbi. Depending on the plan and permissions, it supports finance, billing, scheduling, staff, documents, customers, quality and, in clinic accounts, when the module is on sale, patient care and medical records.

Orbi uses different providers and models. What it can do depends on the plan, permissions, technical limits, and availability. A response from Orbi does not prove that an action was taken. Actions that change data, send messages, or have a financial effect depend on the confirmations and records that the system itself shows.

Features marked Beta, such as the legal templates, may change and have not been reviewed by a lawyer.

3. Plans, free trial, and billing

• Plans: Starter, Standard, and Advanced are purchased through the website. If Corporate and Enterprise are open for sale, they are purchased through a proposal and their own contract.
• Free trial: 7 days, no card required, on the Starter, Standard, and Advanced plans. In the Standard and Advanced trials, Orbi's voice is limited to about 10 minutes; Starter has no voice, not even in the trial. Corporate and Enterprise have no free trial.
• End of trial: since the trial does not require a card, nothing is charged when it ends; to continue, you choose a plan and a payment method.
• Renewal: monthly and annual plans renew automatically at the end of each period until you cancel; the available payment methods are shown on the sign-up screen.
• Introductory price: when a plan has an introductory price, it applies for the first 3 months; from the 4th month on, the list price applies. Both prices are shown before purchase, and we give notice 15 days before the change.
• No activation fee.
• People and view-only access: plans charge per person who enters data, edits, or uses Orbi. View-only access is free.
• iPhone: purchase and payment are made through the website; the iPhone app only signs in to the account. The price is the same on all channels.
• Price changes: we give 30 days' notice; an annual plan already paid keeps its price until the end of the period.
• Times for billing and due dates are shown in Brasília time.

4. Cancellation and right of withdrawal

• You may cancel the monthly plan at any time; access continues until the end of the paid period.
• Right of withdrawal: for online purchases, you may withdraw within 7 days and receive a refund (Código de Defesa do Consumidor, CDC, Brazil's Consumer Protection Code, Art. 49).
• Annual plan: after the 7 days, the unused months become credit for you to use Oxxy again, with no cash refund, valid for 12 months. This rule is shown on the pricing page before purchase.
• After cancellation, the company may request an export of its data before deletion, as described in the Privacy Policy.

5. Accounts and responsibilities

• Keep your credentials secure and provide accurate information.
• The company's administrators invite people, assign roles that fit their job, and remove access that is no longer needed.
• You are responsible for the content you send and for the decisions you make based on the responses.
• You must have the right to use and share the data you send. At clinics, the clinic is responsible for the legal basis for processing patient data.

6. Prohibited use

Do not use Oxxy to:

• violate third-party rights, privacy, intellectual property, or trade secrets;
• create or facilitate fraud, intrusion, malware, spam, or social engineering;
• try to get around login, limits, auditing, billing, or security mechanisms;
• send illegal content or third parties' personal data without a proper basis;
• use AI responses as the sole basis for critical decisions, such as diagnoses, without qualified human review.

7. Intellectual property

Oxxy, its brand, interface, code, and documentation belong to their owners. The content you send remains yours or belongs to whoever holds the rights; you grant us the permission needed to process it and provide the service.

8. Warranties and liability

Oxxy is provided as available. We work seriously to deliver a useful and secure service, but we do not promise that the AI will be perfect, uninterrupted, or error-free. AI responses may be incomplete or wrong; review important information before acting, especially on legal, medical, financial, or security matters.

To the maximum extent permitted by law, our liability is limited to proven direct damages, excluding lost profits, loss of opportunity, or indirect damages, subject to consumer rights where they apply.

Corporate and Enterprise, if open for sale, may have an availability commitment in the contract.

9. Suspension and termination

We may suspend or terminate access in case of violation of these terms, security risk, abuse, legal requirement, or non-payment, giving notice when possible. You may stop using Oxxy at any time.

10. Changes to these terms

We may update these terms. Significant changes are announced by reasonable means, and the date at the top shows the current version.

11. Governing law and venue

These terms are governed by the laws of Brazil. The venue is the court with jurisdiction under the legal rules, subject to the consumer's venue where applicable.
